1. Agreement to Terms

By accessing or using SkaiScraper ("Service"), you agree to be bound by these Terms of Service ("Terms").
If you do not agree, do not use the Service.

2. Overview of the Platform

SkaiScraper is a cloud-based software platform offering:

• Contractor workflow tools
• Insurance claim documentation and automation
• AI-powered inspection analysis
• Damage categorization
• Reporting tools
• Communications tools
• Client and contractor portals
• Photo, document, and data storage

The Service is owned and operated by ClearSkai Technologies, LLC, DBA "SkaiScraper".

3. No Professional Advice

SkaiScraper does NOT provide:

• Legal advice
• Engineering advice
• Adjusting advice
• Architectural advice
• Structural calculations
• Certified inspection results

Any AI-generated output is for informational purposes only and must be reviewed by a qualified human.

4. AI Output Disclaimers & User Responsibilities

SkaiScraper uses AI to generate:

• Roof damage assessments
• Hail/wind detection insights
• Summaries of photos or documents
• Claim narratives
• Recommendation blocks
• Automated forms
• Inspection descriptions
• Content classification
• Estimate formatting suggestions
• Report generation

AI Limitations

You acknowledge and agree:

• AI may generate inaccurate, incomplete, or misleading results.
• AI does not replace qualified inspection, estimating, engineering, or adjusting.
• You must independently verify all information before using it for claims, repairs, bidding, compliance, reporting, or decision-making.
• AI outputs may contain hallucinations, pattern errors, misinterpretations, or false positives.
• AI image analysis may misidentify objects, damage, materials, or conditions.
• AI text summaries may omit critical details.
• AI outputs are not guaranteed to meet insurance carrier requirements.

You agree:

YOU, NOT SKAISCRAPER, ARE FULLY RESPONSIBLE for:

• Verifying accuracy
• Ensuring compliance
• Ensuring code adherence
• Checking measurements
• Determining claim validity
• Providing truthful and accurate documentation

Misuse Prohibited

You may not:

• Submit AI-generated content as certified inspection results
• Use AI outputs to mislead insurers, homeowners, adjusters, or contractors
• Use AI outputs to falsify or exaggerate claims
• Represent AI outputs as legally binding documents
• Attempt to use AI to automate regulated activities (engineering, adjusting, law)

5. Liability Shield for AI Misuse

To the fullest extent permitted by law:

ClearSkai Technologies, LLC is NOT liable for:

• Damages resulting from reliance on AI outputs
• Claim denials or underpayments
• Misuse of automated damage detection
• Code violations in contractor work
• Inaccurate assessments
• Estimating errors
• Any decisions made using AI outputs
• Any financial or legal loss related to AI interpretations

YOU ASSUME FULL RESPONSIBILITY FOR ALL DATA YOU SUBMIT.

6. Contractor & Homeowner Disclaimer

Contractors engaged through the platform are independent businesses.
SkaiScraper is not:

• A contractor
• An adjusting firm
• A construction company
• A party to any agreements between users

SkaiScraper is not responsible for contractor performance, bids, claims, or work quality.

7. Payment Terms / Subscriptions

Using the Pro platform requires a paid subscription via Stripe.
You authorize recurring automatic payments.
See Billing Addendum for details.

8. Acceptable Use Requirements

You may not:

• Upload illegal content
• Use the platform to commit insurance fraud
• Harass other users
• Bypass security systems
• Reverse engineer our code
• Attempt unauthorized access
• Train external AI models using our data
• Upload copyrighted content without permission

DMCA Safe-Harbor procedures apply.

9. Intellectual Property

All software, AI systems, workflows, designs, documents, and branding remain the sole property of ClearSkai Technologies, LLC.

10. Limitation of Liability

To the fullest extent permitted by law:

Our total cumulative liability shall not exceed the fees paid in the previous 12 months.

We are not liable for:

• Loss of profits
• Loss of data
• Business interruption
• Indirect or consequential damages

11. Governing Law

These Terms are governed by the laws of the State of Arizona.

12. Changes to Terms

We may update Terms at any time.
Users will be notified and required to re-accept the updates.
